Petitioner apprehends his arrest in Complaint Case No.727 of 2015 registered under Sections 341, 307 and 504/34 of the Indian Penal Code and under Section 27 of the Arms Act. The complainant earlier lodged Kharik P.S. Case No.138 of 2013, which was registered under Sections 307/34 of the Indian Penal Code and under Section 27 of the Arms Act with the allegation that petitioner fired with intention to kill him which hit on his hand but the police after investigation submitted final form finding the case and accusation against the petitioner false. Thereafter the petitioner filed protest petition and the learned Judicial Magistrate after accepting the final form proceeded on complaint petition and found prima facie
Patna High Court Cr.Misc. No.3762 of 2019(2) dt.25-01-2019 2/2 case to proceed against the petitioner.
Considering the fact that the police after thorough investigation found the case and accusation against the petitioner false, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Naugachia, District Bhagalpur in connection with Complaint Case No.727 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C.
