Petitioner apprehends arrest in a case registered for the offence punishable under Sections 406, 419, 420, 467, 468, 471, 120 (B) and 34 of the Indian Penal Code. It is alleged that this petitioner is involved in cyber crime along with his gang members. It is further alleged that he is the mastermind who operates the gang by providing materials like mobile, ATM, Adhar card etc. and grab innocent people's money by committing Cyber crime.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion. No incriminating materials

Patna High Court CR. MISC. No.3571 of 2023(2) dt.09-05-2023 2/2 were recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent.

Learned counsel for the State opposed the prayer for bail and submitted that from perusal of the case record, it is clear that this petitioner is involved in the Cyber crime and I.O. has also verified the withdrawn amount from the seized ATM card. Witnesses have supported the occurrence and there is recovery of huge items which shows complicity of the petitioner in Cyber crime.

Considering the nature and the gravity of allegation, prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Kaushik/- U T
