JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 06.10.2015 in a case registered for the offences punishable under sections 498(A) of the IPC and under section 3⁄4 of Dowry Prohibition Act. The basic accusation is of torture for non fulfillment of dowry demand.
Learned counsel for the petitioner submits that the petitioner admits the marriage with the informant and he is ready to live with the informant. Statement to this effect has been made in paragraph 12 of the petition, which reads thus:- "12. That the petitioner is always ready to keep his wife with full dignity and respect."
Patna High Court Cr.Misc. No.4065 of 2016 (2) dt.27-01-2016 2/2 Moreover, the investigation against the petitioner has already been concluded.
Considering the nature of accusation and the stand of the petitioner that is still ready to keep his wife, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Araria in connection with Sikty P.S.
