The petitioner apprehends his arrest in Excise Case No.340 of 2018 registered under Section 30(a) of Bihar Prohibition and Excise Act.
On secret information, the house of the petitioner was searched and from the back portion of the house of the petitioner, about 85 liters of Indian made foreign liquor of different brands was recovered.
The learned counsel for the petitioner submits that recovery was made in absence of the petitioner that too from the abandoned portion of house of the petitioner but it appears that from the seizure list, the recovery was made from the back side of the house of the petitioner.
Patna High Court Cr.Misc. No.5166 of 2019(2) dt.30-01-2019 2/2 Considering the aforesaid facts, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
