This is a petition for grant of anticipatory bail for offences under Sections 448, 341, 323, 504, 307 and 34 of the Indian Penal Code and 27 of the Arms Act. For land dispute the petitioner allegedly caused injury with lathi at the head of Umesh Singh, the brother of the informant.
Submission of the petitioner is that there is case and counter case. There is no allegation of repetition of blow and the doctor has found simple injury.
Considering the fact that the petitioner had knowledge that his act might cause death, I am not inclined to grant anticipatory bail to the petitioner in connection with Balia P.S. Case No. 214 of 2016, pending in the Court of the Chief Judicial Magistrate, Begusarai. The prayer for anticipatory bail is rejected. The prayer for regular bail of the petitioner shall be considered without being prejudiced of this order. (Birendra Kumar, J) SA/- U √ T √
