It happens to be a case of gang rape.
By referring to annexure-2 and 3, the petitioner has submitted that he was not in a position to move on the alleged date of occurrence and on account thereof, his name has purposely been introduced at the instance of his enemies. It has further been submitted that the trial has not yet been concluded and petitioner happens to be under custody since the year 2012. Learned Additional Public Prosecutor opposed the prayer.
With reference to annexure-2, from cursory perusal of the same it is apparent that it is not going to help the petitioner.
Patna High Court Cr.Misc. No.20006 of 2015 (2) dt.02-07-2015 2/2 With reference to annexure-3, that happens to be of the year 2013. Again the same is not going to give any support. Therefore, the prayer for bail is rejected.
