2. The petitioners apprehend their arrest in connection with Kawakol P.S. Case No. 331/ 2024 dated 27.09.2024 registered for the offence(s) punishable under Section(s) 305(e) and 317(4) of the BNS.

3. Heard both the sides and perused the FIR.

4. In the facts and circumstances of this case and considering the averments made in the petition and mainly petitioners' plea that they have no concern with alleged tractor which was found being loaded with sand and they have been

No.2410 of 2025(2) dt.12-02-2025 2/2 made accused only on the basis of the disclosure of their identity by the co-villagers to the police but their names have not been disclosed in the FIR and further coupled with fair and clean antecedent of petitioner No.2, though, the petitioner No.1 has one criminal antecedent but the same does not relate to Mines and Minerals Act, this court is inclined to grant the relief of anticipatory bail to the petitioners. Accordingly, let the petitioners named-above, in the event of their arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Kawakol P.S. Case No. 331/ 2024 on furnishing bail bond of Rs. 20,000/-(Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 482(2) of the BNSS.
