No doubt, petitioner does criminal antecedent of several cases but in the present case, he was not caught on the spot nor anything was recovered from his conscious possession and his name surfaced in this case on the basis of statements made by those persons who were arrested on the spot.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Sikrahna at Dhaka, East Champaran in Ghorasahan P.S. Case no. 151/2013.
