JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 05-06-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Bhagwanpur P.S. Case No.21 of 2019 registered for the offence punishable under Section 147, 149, 302 and 307/504 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that there is general allegation against all the seven persons, named in the First Information Report, including the petitioner, of having assaulted the informant's husband. He has submitted that in similar circumstance, co-accused Arvind Mahto has been allowed regular bail by this Court by an order dated 18.12.2019 passed in Cr. Misc. No. 71610 of 2019.

On perusal of the First Information Report, I find substance in the submission made on behalf of the petitioner

Patna High Court CR. MISC. No.1145 of 2020(3) dt.05-06-2020 2/2 that his case is identical with the case of Arvind Mahto. Considering the above, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai, in Bhagwanpur P.S. Case No. 21 of 2019.
