The petitioner is languishing in custody since 05.08.2014 in a case registered for the offences punishable under Sections 147, 148, 149 and 302 of the Indian Penal Code. Several accused persons including the petitioner came variously armed when it is specifically alleged that Azhar Alam assaulted with Farsa on the head of the informant and others assaulted with lathi, fists and slaps. Considering the specific overt act against Azhar Alam only similarly situated co-accused persons have been granted bail vide Cr. Misc. Nos. 3805 of 2014, 5795 of 2014 and 31439 of 2014.

No.12969 of 2015 (02) dt.01-04-2015 2/2 Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 5th Additional Sessions Judge, West Champaran at Bettiah in connection with Sessions Trial No. 315 of 2014/617 of 2014 arising out of Majhaulia P.S. Case No. 435 of 2013.
