This application for regular bail arises out of Rafiganj P.S. Case No. 61 of 2016(Sessions Trial no. 393 of 2017/255/2018, disclosing offences under Sections 304B/34 of the Indian Penal Code.
The petitioner's prayer for regular bail has been rejected thrice by this Court. The petitioner is the husband of the deceased. It transpires that the informant had disclosed in the First Information Report, explicitly, the manner in which the occurrence had taken place and the role which the petitioner had played. Few days after the statement of the victim was recorded, she died.
Learned counsel for the petitioner has submitted that

No.1285 of 2020(3) dt.19-06-2020 2/2 the prosecution witnesses have turned hostile and despite the fact that the charge-sheet was submitted for the offence punishable under Section 306 of the Indian Penal Code, the Court below has framed charge for the offence punishable under Section 304B of the Indian Penal Code.
Be that as it may, considering the fact that the deceased herself is the informant on whose statement, the First Information Report was registered, I am not inclined to grant the petitioner privilege of regular bail for the present. This application is rejected.
The Court below must expedite the trial and conclude it within six months from today.
