2. The petitioner seeks regular bail in connection with katihar (Nagar Sahayak) P.S. Case No. 516 of 2023 registered on 10.07.2023 lodged under Sections 399, 402, 413, 414 of the I.P.C. and Section 25(1-a)/26/35 of the Arms Act.
3. As per the prosecution case, F.I.R. has been lodged against six named accused persons including the present petitioner. It has been specifically alleged that in the said case, one country made loaded pistol and four live cartridges have been recovered from the possession of the petitioner.
4. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that petitioner

5. Counsel further submits that co-accused persons have been granted bail by co-ordinate Bench of this Court vide order dated 07.02.2024 passed in Cr. Misc. No. 5431 of 2024 after framing of charge.
6. Learned counsel for the State opposes the prayer for bail.
7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail after framing of charge if the charge is not framed yet as well as on being satisfied by the trial court that petitioner is not absconding in any of the case which is mentioned below and on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Katihar (Nagar Sahayak) P.S. Case No. 516 of 2023, subject to the conditions laid down under Section 437 (3) of the Cr.P.C.
