JUSTICE CHAKRADHARI SHARAN SINGH ORAL JUDGMENT & ORDER Date: 02-01-2018 The petitioner passed Secondary School Examination, 2013 and All India Senior School Certificate Examination, 2015. It is the case of the petitioner that his date of birth has been wrongly entered as 03.10.1998, in place of 03.10.1996, in the certificates and other documents, issued by the Central Board of Secondary Education (in short 'the CBSE'). The petitioner had applied for correction before the CBSE, which has been rejected by the impugned order, dated 04.10.2016, on the ground of his application for correction being time barred. On the date when the petitioner's application was rejected by the CBSE, the period of limitation, seeking such correction, was prescribed as one year.

2. The period of limitation has now been extended to five years.

3. Whereas I do not find any illegality in the order, which is being impugned in the present writ application, I dispose of the writ application by remanding the petitioner's case back to the CBSE to consider the same afresh, in view of the limitation period for seeking correction in the date of birth, period of limitation having already been extended to five

4. The Regional Officer, CBSE, Patna (respondent No. 4), is directed to consider the petitioner's case afresh and take a final decision within a period of two months from the date of receipt/production of a copy of this order.
