====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 08-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Patrakar Nagar P.S. Case No. 509 of 2018, instituted for the offence under Section(s) 379 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade has been held. The name of petitioner has been disclosed by coaccused Arun Kumar Thakur from whose possession the alleged stolen Motorcycle has been recovered after two days of the occurrence. Counsel for the petitioner further submits that co-accused Arun Kumar @ Arun Rai has already been granted

Patna High Court Cr.Misc. No.7535 of 2019(2) dt.08-02-2019 2/2 bail by coordinate Bench of this Court vide order dated 15.01.2019 passed in Cr. Misc. 1849 of 2019.

Petitioner is in custody since 27.9.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge X, cum Additional Chief Judicial Magistrate, Patna, in connection with Patrakar Nagar P.S. Case No. 509 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
