The petitioner seeks regular bail in connection with Special (Excise) Case No.590 of 2019 registered for offences punishable under Sections 30(a), 38(i), 41(i) of the Excise Act. Allegation against the petitioner is about recovery of 116.250 ltrs. of liquor from the vehicle of the petitioner, who is said to be driver.
Submission of the learned counsel for the petitioner is that he is not driver of the truck and not arrested at the spot, having no criminal antecedent and he is in custody for 1 1⁄2 months.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court CR. MISC. No.2907 of 2020(2) dt.20-01-2020 2/2 circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Saharsa in connection with Nawhatta P.S.case No.114 of 2019/Special (Excise) Case No.590 of 2019.
With the aforesaid observation, this application is allowed.
