JUSTICE AMARESH KUMAR LAL ORAL ORDER Heard learned counsel for the petitioner and the State. 6-05-2015 The petitioner seeks bail in a case registered for the offence punishable under Section 376 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has moved this Court earlier for grant of bail which was disposed of vide order dated 19.6.2013 with an observation to conclude the trial preferably within a period of six months. The trial has not yet been concluded.

A report was called for from the learned trial court. The report of the trial court shows that five witnesses including the informant and the victim girl have already been examined and two more witnesses and the doctor and the investigating officer, are to be examined. The trial court is expected to conclude the trial within a period of six months.

Patna High Court Cr.Misc. No.16205 of 2015 (3) dt.06-05-2015 2/2 Considering the facts and circumstances, in my opinion, the petitioner does not deserve bail at this stage. Let the trial of the petitioner in Mojahidpur P. S. Case no. 82 of 2012 giving rise to S. T. no. 1321 of 2012/Tr. No. 326/2013 be expedited.
