JUSTICE SANJAY PRIYA ORAL ORDER 26-06-2019 Heard learned counsel for the petitioner and learned counsel for the opposite party no.2 The instant application has been filed for cancellation of anticipatory bail granted to opposite party no.2 by order dated 3.8.2018 passed in Cr. Misc. no. 39953 of 2018. Learned counsel for petitioner ( informant) submits that the deceased has earlier filed application before the police station and also in the Court vide Annexure-2 series stating that there is threat to his life.

Learned counsel for the opposite party no.2 has submitted that no any case earlier has been registered on such application filed by the deceased.

Patna High Court CR. MISC. No.14634 of 2019(7) dt.26-06-2019 2/2 Allegation against the opposite party no.2 in the written report is utmost of last seen. As per written report there is no eye witness in the case.

Therefore, this Court does not find any merit in the application for cancellation of anticipatory bail granted to opposite party no.2 by order dated 3.8.2018 passed in Cr. Misc. no. 39953 of 2018.

The prayer for cancellation of anticipatory bail is, accordingly, rejected.
