JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. According to prosecution case itself, it was co-accused Munna Cuhoudhary, who was involved in illegal trade of spirit and so far as petitioner is concerned; he happens to be brother of the co-accused, Munna Choudhary and there is only allegation against him that he used to help the co-accused, Munna Choudhary in the aforesaid illegal trade. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 13-12-2015.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.3383 of 2016 (2) dt.04-02-2016 2/2 10,000/- (ten thousand) with two sureties of the like amount each in connection with Maharajganj P.S. Case No. 315 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate-II, Siwan.
