JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was caught with stolen motorcycle just after the alleged occurrence for which petitioner is in jail custody since 21.6.2015.

Contention on behalf of the petitioner is that no such occurrence as alleged in the first information report did ever take place and as a matter of fact the present case was brought by the informant due to some dispute.

Moreover, considering the period of detention of the petitioner in jail custody as well as facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two
