Let the defect(s) be removed within two weeks of the complete start of the physical Court in normal course. Petitioner, who is in custody since 22.08.2020, seeks regular bail in connection with Mohiuddin Nagar P.S. Case No. 26 of 2020 registered for offences punishable under Sections 302/34 of the Indian Penal Code.
Taking into consideration the serious nature of allegation made against the petitioner as well as the materials which have surfaced in course of investigation, there is every likelihood that if the petitioner is released on bail at this stage, he will indulge in tampering the evidences and influencing the
Patna High Court CR. MISC. No.13468 of 2021(12) dt.11-04-2022 2/2 witnesses. The learned trial Court is directed to conclude the trial expeditiously well within a period of six months. If no substantial progress takes place in conduct of the trial, the petitioner, if so advised, may renew his prayer for bail before after the aforesaid period.
Superintendent of Police, Samastipur, is directed to produce all the prosecution witnesses on the date fixed by the trial Court without fail.
A copy of this order may be communicated to the Superintendent of Police, Samastipur.
With the above observation, the present bail application is disposed of.
