The petitioner is languishing in custody since 09.12.2013 in a case registered for the offences punishable under Sections 341, 323, 302 and 307/34 of the Indian Penal Code. It is alleged against the petitioner that he caused injury with Saif (Sharp cutting weapon) to the father of the informant causing cut injury on the ear and pierced Saif in the chest of the father of the informant, who subsequently succumbed to the injury.

It is submitted by learned counsel for the petitioner that during investigation it was found that the alleged Saif used by the petitioner contain no blood stain and due

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. It is submitted by learned counsel for the State that the post-mortem report corroborates the accusation levelled against the petitioner.

Considering the nature of accusation, this Court is not inclined to grant bail to the petitioner in connection with Sessions Trial No. 05 of 2014 arising out of Barbigha (Keuti O.P.) P.S. Case No. 211 of 2013 pending in the court of learned Additional Sessions Judge, Sheikhpura.

Accordingly, the prayer for bail of the petitioner is rejected.

Let the trial be expedited.
