ANJANA MISHRA ORAL ORDER 27-05-2015 Heard learned counsel for the petitioner and the learned counsel for the State.
The petitioner is in custody since 28.1.2015 in connection with Paras Bigha P.S. Case No.76 of 2014 registered for the offences under Sections 272 and 273 of the Indian Penal Code and Section 47A of the Excise Act.
Learned counsel for the petitioner submits that the alleged recovery of country made liquor was not made from the conscious possession of the petitioner; rather it was alleged to have been recovered from empty field.
Considering the aforementioned submissions and also the fact that the petitioner has no previous criminal history, let the above named petitioner be released on bail on his furnishing bail
Patna High Court Cr.Misc. No.12630 of 2015 (2) dt.27-05-2015 2/2 bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Deshmukh, learned Judicial Magistrate, 1st Class, Jehanabad, in connection with Paras Bigha P.S. Case No.76 of 2014.
