ANJANA PRAKASH ORAL ORDER 04-05-2016 It has been submitted that in the counter case instituted for the same occurrence, discharge petition is pending whereas in the present case almost all the witnesses have been examined. The trial Court report also points out the fact that all the witnesses have been examined in the present trial. The petitioner undertakes to be physically present on each date of trial.
Having considered the aforesaid, the application is allowed. And the Petitioner, above named, be released on bail on furnishing bail bond of Rs.5,000/-(Five Thousand) with two sureties of the like amount each or any other surety to be fixed by the Court below to the satisfaction of 2nd Additional District Judge, East Champaran Motihari in Sessions Trial No. 252 of 2014 arising out of Adampur P.S. Case No. 104 of 2012 subject to the conditions,

The bailor will undertake to furnish information to the court about any change in the address of the petitioner, That the petitioner will be physically present on each date of trial and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
