Petitioner seeks bail in a case registered for the offences punishable under Sections 341,302,323,109,337/34 of the Indian Penal Code.

The petitioner, his wife and others are alleged to have assaulted to the father of the petitioner for the reason that he was not ready to execute the sale deed, as a result whereof, he died. Widow of the deceased, who is mother of the petitioner, is informant of this case and eye witness of the occurrence. Petitioner is in custody since 26.05.2018. Submission is that when the informant was going to depose in favour of the petitioner, two other brothers

Patna High Court CR. MISC. No.3767 of 2019(3) dt.18-04-2019 2/2 committed murder of the informant. The act of other brothers cannot minimize the allegation against the petitioner, hence, I am not inclined to enlarge the petitioner on bail in connection with Hilsa P.S.Case No.253 of 2018 corresponding to G.R.No.833 of 2018 pending in the court of learned Additional Chief Judicial Magistrate-II, Hilsa, Nalanda. Prayer is refused. Learned Trial Court is directed to expedite the trial.
