Petitioner is accused in connection with Agrer P.S. Case No. 56 of 2019 registered under Sections 341, 323, 376 of the I.P.C.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in this case. On perusal of first information report itself, it appears that the informant is a married lady. She made physical relationship with the petitioner according to her own desire. Hence, section 376 of I.P.C. is not made out against the petitioner. It is also submitted that petitioner has no criminal antecedent and is in custody since 28.06.2019.
