2. The petitioner apprehends his arrest in Falka P.S. Case No. 230 of 2021 registered for the offences punishable under Section 392 of the Indian Penal Code pending in the Court of learned A.C.J.M.-III, Katihar.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today and seeks regular bail, the learned Court below would pass the
