The petitioner is the son of the deceased who died in the year 2009 because of electrocution. The details regarding the lodging of U.D. Case, post-mortem report and the application preferred by the wife of the deceased, has been brought on record.
It appears that in the year 2009, according to the circular prevalent at that time the wife of the deceased (mother of the petitioner) was sanctioned to be paid Rs. 1 Lakh as compensation.
The present petition has been filed after about
Patna High Court CWJC No.1301 of 2017 dt.17-02-2020 2/2 8 years of the death of the deceased. The brother of the petitioner who had lodged the case also has not come forward to agitate that the compensation given to his mother was inadequate.
Under the aforesaid circumstances, this Court cannot direct for reconsideration of the compensation amount which has been paid to the family. However, in the absence of any averment in the writ petition or in the counter affidavit whether the sanctioned amount has reached the wife of the deceased, this Court only provides that if the compensation has not been paid, it shall be paid without any delay.
The writ petition stands disposed off with the aforesaid direction/observation.
