The petitioner has preferred this application for grant of regular bail in a case registered under sections 366 and 363 of the Indian Penal Code.

As per the prosecution case, the accused persons including the petitioner herein are stated to have kidnapped the 17 year old daughter of the informant for the purpose of marriage.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case for the reason that as per information received her son eloped with the daughter of the informant and in a false case all the family

Patna High Court CR. MISC. No.3524 of 2022(2) dt.08-02-2022 2/2 members of the petitioner including petitioner herself were implicated. The petitioner is a lady and as per the documents brought on record by way of supplementary affidavit including the report of the Medical Board, the petitioner is a patient of cancer and requires further intensive treatment. The petitioner is in custody since 22.9.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the contents of the supplementary affidavit together with chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Tisiauta P.S. Case no. 16 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Vaishali at Hajipur.
