JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report on the accusation that he along with his son confined the informant's husband in his house and mercilessly beaten him and subsequently, on the next morning the informant's husband was dropped by the petitioner and his son at door of the informant. The informant took her husband to the hospital where her husband died in course of his treatment.

The contention on behalf of the petitioner is that the aforesaid accusation is not corroborated by the post mortem report of the deceased which is evident from perusal of Annexure-2 to

Patna High Court Cr.Misc. No.4561 of 2016 (2) dt.10-02-2016 2/2 the petition because no external injury was found on the person of the deceased. It is further submitted by him that the husband of the informant is drunkard and he took excess liquor as a result of which he died in course of his treatment.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Gopalganj in connection with Uchakagaon P.S.Case No. 25 of 2015.
