JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 02-03-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends her arrest in connection with Akbarpur P.S. Case No. 243 of 2020, registered for the offences punishable under Sections 302 and 120 (b) of the Indian Penal Code. The informant, Brajesh Singh, lodged the FIR with allegation that the marriage of his daughter Riya Rani (deceased) was solemnized with co-accused Mantu Singh 8-9 years prior to the alleged occurrence. On 15.05.2020, the informant got an information that the in-laws of his daughter had done her to death and they are going to cremate the dead body. The informant has mentioned next that he came to know that the co-accused persons named in the FIR including the present petitioner have killed the deceased by strangulating her.

Learned counsel for the petitioner has submitted that in paragraph No. 6 of the case diary contains the place of occurrence. It shows that in the southern-eastern room of the house the deceased was found dead and the informant was apprised that the deceased strangulated herself to death by putting a knot of saree and fixing it to the fan.

Learned counsel for the petitioner has also submitted that considering these facts, co-accused Indradeo Singh and Sobha Devi who are father-in-law and mother-in-law of the deceased have been granted anticipatory bail by this Court vide order dated 12.01.2022 in Cr. Misc. No. 14404 of 2021 and the present petitioner is married nanad of the deceased.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of her arrest or surrender, be released on anticipatory bail within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Akbarpur P.S. Case No. 243 of 2020, subject to the conditions as laid
