JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 30-06-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks regular bail in a case registered for the offence punishable under sections 147, 148, 149, 302, 201 of the Indian Penal Code and 27 of the Arms Act and Section 3 and 17 of the U.A.P. Act and section 17 of the C.L.A. Act.
There was indiscriminate firing in a Diyara whereupon the police personnel gone and found three dead bodies. Accordingly, the informant A.S.I. recorded his own Fardbeyan against unknown. During course of investigation, it is evident that much more dead bodies have also been found. So far complicity of the petitioner is concerned, from paragraph 61 onward of the case
Patna High Court Cr.Misc. No.17913 of 2015 (3) dt.30-06-2015 diary, it is apparent that witnesses have identified him as one of the members of the mob.
Accordingly, petitioner Rasbihari Singh is directed to be enlarged on bail on furnishing bail bond of Rs.10000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Munger in Sessions Trial No. 666 of 2011 arising out of Bariarpur P.S. Case No. 127 of 2010.
