JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, the name of petitioner came in confessional statements of co-accused persons. The submission on behalf of the petitioner is that several co-accused persons, in whose confessional statements the name of petitioner surfaced in this case, have already been granted privilege of bail by different Benches of this Court. It is further contended by him that so far as, criminal antecedent of the petitioner is concerned, he has been remanded in several cases which has been lodged against unknown persons.

Patna High Court Cr.Misc. No.9243 of 2015 (3) dt.07-05-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Muzaffarpur in connection with Deoriya P.S.Case No. 21 of 2009, subject to the condition that petitioner shall attend the trial court on each and every date for the period of seven months or till conclusion of his trial which ever is earlier and if he fails to do so on two consecutive dates without any reasonable cause, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
