JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 The petitioner seeks regular bail in connection with Narkatiaganj Railway P.S. Case No. 87/2019, registered for offences punishable under Sections 379, 411 and 34 of the Indian Penal Code.

Allegation as per F.I.R. is that petitioner committed theft of Rs. 2500/- of informant, while the informant was sleeping in train, in the meantime, the informant woke up and raised alarm, thereafter, the petitioner was caught by the Railway police.

It has been submitted on behalf of the petitioner that he has no criminal antecedent and has falsely been implicated in this case he has been in judicial custody for three months. Heard learned A.P.P. also.

Patna High Court CR. MISC. No.1301 of 2020(2) dt.16-01-2020 2/2 Having heard both sides, considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. However, if the trial is not concluded within a period of three months, petitioner will be at liberty to renew his prayer for bail.
