JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-03-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. C-1-572 of 2017, lodged for the offences punishable under Sections 498A/34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act. Allegation against the petitioner is of demand of dowry and subjecting the opposite party No.2 to cruelty with respect to demand.

Submission of learned counsel for the petitioner is that he is still ready to keep her with him and he has already filed a petition under Section 9 of Hindu Marriage Act for restitution of conjugal right and opposite party No.2 has appeared in that case but she is not ready to live with the

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. (Sadar) at Sitamarhi, in connection with Complaint Case No. C1/572/2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that the petitioner has to co-operate in disposal of the case filed under Section 9 of the Hindu Marriage Act.
