2. Petitioner seeks bail who is in custody since 03.11.2025 in connection with Punaura P.S. Case No. 32 of 2024 for the offences punishable under Sections 304, 201 and 34 of IPC.
3. The prosecution story, in brief, is that during patrolling the informant received the information that in village Mirzapur at cremation ghat a dead body has been consigned and kept in ditch. The informant after giving information to the P.S went there and found someone has been kept on the ditch and bad smell was coming. He informed the officer in-charge to go reach there and after some time officer in-charge of P.S Punaura reached at 14:00 hours and in the presence of Circle Officer, the

No.9947 of 2026(3) dt.02-04-2026 2/3 soil was removed and after that they have found 1.5 kg human corps and after the documentation by the officer in-charge, the remains of the human body was sent to Sadar Hospital, Sitamarhi for examination. The informant further stated that the people of the locality has not revealed anything about that and informant raised the suspicion that after death some unknown person have tried to conceal the dead body after burning it and on the aforesaid basis the present case has been registered.
4. Learned counsel for the petitioner submits that petitioner has clean antecedent and is innocent and he has falsely been implicated in the present case. It is further submitted that the allegation as alleged in the FIR is forged and fabricated and the petitioner has not committed any offence as alleged in the FIR.
5. The learned Additional Public Prosecutor for the State on the basis of materials available on record and the case diary has vehemently opposed the prayer for bail of the petitioner and submits that it has been referred in paragraph nos. 23 and 25 of the case diary that one mobile phone has been recovered from the possession of the petitioner which belongs to the deceased and petitioner has confessed his complicity in the present occurrence.

6. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail in connection with Punaura P.S. Case No. 32 of 2024 pending in the Court of learned ADJ-II, Sitamarhi.
7. Prayer is refused.
