JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-05-2015 Heard learned counsels for the petitioner and the State. The petitioners are languishing in jail since 23.01.2015 and 28.01.2015 in a case registered for the offences punishable under Section 379 of the Indian Penal Code.
The motorcycle of the informant was stolen leading to the lodging of the present case, subsequently motorcycle was recovered from the possession of the petitioners as the petitioner Munna Kumar was driving the same and petitioner Indrajeet
Patna High Court Cr.Misc. No.14911 of 2015 (3) dt.05-05-2015 2/2 Kumar was the pillion rider.
It is submitted by learned counsel for the petitioners that subsequently on recovery of the motorcycle a case under Section 414 of the IPC was registered against petitioner Munna Kumar in which he is on bail, though, petitioner Indrajeet Kumar has no criminal antecedent. Statements to that effect have been made in para 3 of each petition.
Considering the aforesaid facts, let the above named petitioners be released on bail, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Nalanda at Bihar Sharif in connection with Laheri P.S. Case No. 272 of 2014. (Dinesh Kumar Singh, J) Amrendra/- U T
