Petitioner is languishing in custody since 10.10.2014 in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code. Accusation is of killing the wife by the petitioner after 13 years of marriage.
It is submitted by the learned counsel for the petitioner that the victim went traceless for which necessary information was given to the informant's family but on subsequent recovery of the dead body the accusation was levelled. There is no eye witness to the occurrence and only on suspicion accusation has been levelled.
The accusation against the petitioner has not been controverted by the learned A.P.P.
Patna High Court Cr.Misc. No.12937 of 2015 (4) dt.30-06-2015 Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Birpur, Supaul in connection with Kunauli P.S. Case No. 63 of 2014.
The learned court below will be at liberty to cancel the bail bonds of the petitioner on default for two consecutive occasions.
