JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-01-2019 Petitioners apprehend their arrest in connection with Rajauli P.S. Case No. 288 of 2017 registered for the offence punishable under Sections 3, 4 and 5 of Explosive Substance Act.

Allegation is of recovery of Detonator and other explosive substance and petitioners and other accused persons are named in the FIR. It appears that petitioners are accused in one more case of similar nature.

Submission of learned counsel for the petitioners is that for the same occurrence two cases have been lodged and except that there is no other case against them and further seizure list does not show any recovery from their possession.

Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioners, rather they should surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order. With the above observation, this application is dismissed.
