The petitioner seeks bail in a case registered for the offence punishable under Sections 395, 397of the Indian Penal Code.
When the informant was going to give medicines to his friend, the accused persons restrained him and asked to give his bike. On objection, the accused persons fired at him and took away his bike, mobile, cash amount of Rs. 4,000/- and other documents.
Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He submits that nothing has been recovered from the conscious possession of the petitioner. He submits that the petitioner has been made accused in this case on the statement
Patna High Court CR. MISC. No.13433 of 2021(3) dt.27-09-2021 2/2 of villagers. He submits that the informant has not taken the name of the petitioner. He further submits that petitioner bears one criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 25.08.2020.
Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Baleriganj P.S.
