The petitioner has filed the instant application for grant of regular bail in connection with Laheri P.S. Case No. 48 of 2022 registered under sections 379, 414 and 34 of the Indian Penal Code.
Allegation against the petitioner is that he used to commit theft of motorcycles and also used to sell them. Further alleged that on the basis of information, police seized some stolen motorcycles from other co-accused persons. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is submitted that the petitioner was not arrested on spot and nothing incriminating
Patna High Court CR. MISC. No.2474 of 2023(2) dt.03-04-2023 2/2 article has been recovered from the possession of the petitioner. It is further submitted that the name of the petitioner came in the F.I.R. on the basis of confessional statement of other coaccused, namely, Shubham Kumar before the police and the petitioner has been remanded in this case from another case. There is no cogent material came against the petitioner. He is languishing in judicial custody since 13.06.2022. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as the custody of the petitioner, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Laheri P.S. Case No. 48 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-V, Nalanda at Bihar Sharif.
