JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-03-2015 Petitioner is languishing in custody since 19.01.2014 in a case registered for the offences punishable under Sections 307/34 of the I.P.C and Section 27 of the Arms Act.
It is alleged that this petitioner ordered one Naresh Yadav to shoot Ajit yadav, the brother-in-law of the informant but the firing hit to the informant on her neck. It is submitted by learned counsel for the petitioner that specific accusation of firing is against Naresh Yadav.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Biharsharif, Nalanda in connection with Manpur P.S.
Patna High Court Cr.Misc. No.9809 of 2015 (2) dt.17-03-2015 2/2 Case No. 88 of 2014.
Since the petitioner is accused in three other cases, let learned Court below cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in similar nature of offence or defaults for three consecutive occasions during trial.
