Versus
The State of Bihar & Ors .... .... Respondent/s ====================================================== Appearance :
For the Petitioner/s : Mr. Bipin Bihari Singh Mr. Upendra Kumar Choubey For the Respondent/s : Mr. (SC20) ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 25-01-2017 Heard both sides.
The petitioner filed this writ petition for quashing the order dated 05.04.2008, as contained in Memo No.5, issued under the signature of Mukhiya, Gram Panchayat Raj, Kolhua, by which service of the petitioner was terminated on the ground that he was appointed on the basis of certificate of Hindi Sahitya Sammelan, Allahabad, which is equivalent to Intermediate pass certificate. The same issue was decided by this court in CWJC No. 14634 of 2010 (Anju Kumari vs. the State of Bihar & Ors.). Anju Kumari, petitioner of CWJC No. 14634 of 2010, preferred L.P.A. No. 855 of 2011 and the same was also dismissed holding that certificate of Hindi Sahitya Sammellan, Allahabad is not recognized and one cannot claim appointment on the basis of such certificate.
Patna High Court CWJC No.12717 of 2008 (3) dt.25-01-2017 2/2 It appears that petitioner also got appointment on the basis of certificate of Hindi Sahitya Sammellan, Allahabad. Therefore, I find no merit in this writ petition and the same is, accordingly, dismissed.
