The petitioner apprehends his arrest in connection with Rohtas P.S. Case No.211 of 2022 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from possession of the petitioner. The petitioner has got no criminal antecedent. Learned A.P.P. for the State vehemently opposed the prayer for bail of the petitioner stating that altogether 10 litres of country made liquor has been recovered from the motorcycle which belongs to the petitioner. The allegation against the petitioner is that he is involved in illegal trade of liquor with

Patna High Court CR. MISC. No.4337 of 2023(2) dt.28-04-2023 2/2 other accused. Therefore, the petitioner does not deserve anticipatory bail.

Having considered the above facts and circumstances of the case as well as nature of the allegation made against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for bail is rejected. (Arvind Srivastava, J) Harish/- U T
