JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-08-2018 The petitioner seeks a direction to the respondent the Bihar School Examination Board to conduct compartmental examination of Primary Teachers Training Examination, which was held in the year 2012 and the result of which was published in 2013. The petitioner, in the said examination, had failed in Educational Psychology. She had missed to secure the pass marks only by one mark and was, therefore, declared 'fail'. It is the petitioner's case that though she has cleared Teachers Eligibility Test (TET), and since she has been declared 'fail' in the examination, held in the year 2012, she cannot have benefit of clearing Teachers Eligibility Test.

Patna High Court CWJC No.5933 of 2018(2) dt.03-08-2018 2/2 It is evident from the pleadings on record, that the petitioner had appeared in the Intermediate Examination in 2013. She has approached this Court in 2018. Whether the petitioner can at all be allowed to appear in the compartmental examination, five years after having failed in the year 2013, is a matter which has to be seen first by the competent authority. This application is, accordingly, disposed of with an observation that if the petitioner approaches the competent authority under the Bihar School Examination Board, her grievance shall be considered in respect of Primary Teachers Training Examination, held in the year 2012, in accordance with law.

This disposes of the application.
