08-04-2015 Heard Sri Bal Bhushan Choudhary, learned counsel for the petitioner and Smt. Anita Kumari Singh, learned Addl. Public Prosecutor.

This is the third attempt for grant of bail on behalf of the petitioner in connection with S.T. No.1153 /2012 (Arising out of Phulwarisharif ( Janipur )P.S. Case No.223/2012). Earlier, the prayer for bail was rejected in view of the fact that the petitioner was main assailant in the present case. By order dated 18.03.2015, a report was called for from the court below regarding stage of the trial, which has been received and kept at Flag-A. The report suggests that out of eight chargesheeted witnesses, seven witnesses including the informant as well as Medical Officer have

Patna High Court Cr.Misc. No.6647 of 2015 (3) dt.08-04-2015 2/2 already been examined. Only Investigating Officer is to be examined, for which process has already been issued. In view of facts and circumstances, particularly the fact that out of eight chargesheeted witness, seven witnesses have already been examined, there is no reason to review of my earlier order. Accordingly, the prayer for bail again stands rejected. While rejecting the prayer for bail, keeping in view the fact that the petitioner is in custody since June,2012, it is desirable to direct the concerned Superintendent of Police i.e. Superintendent of Police, Patna to ensure appearance of Investigating Officer for his examination.

Let a copy of this order be sent to the concerned Superintendent of Police for its compliance.

The petition stands dismissed.
