JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-12-2021 Heard Mr. Manoj Kumar, the learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Excise Case No. 178C2 of 2020, dated 13.12.2020, instituted for the offences under Sections 30(a), 32, 41 and 56(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

18 litres of Mahuwa liquor and 450 kgs. of Mahuwa flower along with the wherewithals for brewing liquor were recovered from a field belonging to one Sagar Yadav. So far as the petitioner is concerned, it is alleged that he was seen fleeing away from the place of raid.

No.13077 of 2021(2) dt.24-12-2021 2/2 The learned counsel for the petitioner has submitted that he is a landless labourer and he may have been identified by the local Chowkidar moving towards some place. That by itself, it has been argued, cannot be an evidence to connect the petitioner with the offence. The petitioner has clean antecedents.

Regard being had to the facts afore-stated, the petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge-II-Cum-Special Judge (Excise), Lakhisarai in connection with Excise Case No. 178C2 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
