JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-02-2024 The present writ petition has been filed seeking the following relief:- "That this writ petition is being filed before this Hon'ble High Court on behalf of the aforesaid petitioner for issuance of a writ in the nature of "Certiorari" for setting aside the Siwan District order no.1067/2020, passed on 31.08.2020, as contained in memo no.3618/2020, issued under the signature of Superintendent of Police, Siwan whereby and whereunder the petitioner has been dismissed from service who was working on the post of constable, without following the

And further prayer of the aforesaid petitioner is to command and direct the state respondents to reinstate the petitioner hereinabove on the post of constable without brakeage in his service and with all back salary as well as all consequential benefits/ monetary benefits with due interest thereon, which the petitioner hereinabove is legally entitled to."

After some arguments, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to challenge the aforesaid order dated 31.08.2020, passed by the Superintendent of Police, Siwan by filing appropriate appeal. Liberty so sought is granted.

It is needless to state that in case appropriate appeal is filed within a period of two weeks from today, the same shall be heard on merits by the appellate authority and a reasoned and a speaking order shall be passed thereon, within a period of six weeks, thereafter.
