JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 01-05-2015 Heard learned counsels for the petitioner and the State.

The petitioner is languishing in custody since 07.01.2015 in a case registered for the offences punishable under Sections 409, 419 and 420 of the Indian Penal Code. Petitioner being the Incharge of the Paddy Purchase Centre, Baniapur misappropriated 6200 quintals of paddy worth Rs. One crore.

It is submitted by learned counsel for the petitioner that the major part of the purchased paddy were supplied to the Millers by the petitioner and his predecessor

Patna High Court Cr.Misc. No.14575 of 2015 (02) dt.01-05-2015 2/2 Satyendra Nath Singh and the District Magistrate vide letter No. 845 dated 10.10.20914 directed for lodging FIR against three persons but the petitioner was only victimized and the investigation has already concluded. Moreover, Certificate Case No. 15/14-15 has also been lodged against the petitioner. It is submitted by Mr. Shailendra Kumar Singh, learned counsel for the Bihar State Food Corporation that the petitioner being the Incharge of the Paddy Purchase Centre has misappropriated 6200 quintals of paddy worth Rs. One crore and recently FIR has been lodged against others also. Moreover, the petitioner has already been charge-sheeted.

Considering the fact that the alleged misappropriation has been made by the officials of State Food Corporation and the Millers and investigation has already concluded, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Saran at Chapra in connection with Baniyapur P.S. Case No. 07 of 2015.
