04-03-2020 Heard learned counsel for the parties.

The petitioner apprehends his arrest in Rajapakar P.S. Case No. 206 of 2019 registered for the offence under Sections 25(1-b)A, 26 and 35 of the Arms Act. As per F.I.R., recovery of three live cartridges has been shown from the house of petitioner.

It is submitted on behalf of petitioner that petitioner is named in the F.I.R. on the basis of confession of co-accused Abhishek Kumar. It is further submitted that petitioner is innocent and has committed no offence and he has falsely been implicated by his enemies. It is further submitted that alleged recovery of cartridges has been implanted by the police. No case under the Arms Act is made out against the petitioner. Petitioner has got no criminal antecedent.

Considering the aforesaid facts and circumstances as

Patna High Court CR. MISC. No.4222 of 2020(2) dt.04-03-2020 2/2 well as nature of accusation, in the event of his arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Rajapakar P.S. Case No. 206 of 2019, subject to condition, as laid down under Section 438(2) of the Cr.P.C.
