The petitioner is languishing in custody since 26.12.2014 in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

The informant was robbed Rs.24,000/-, gold rings, two ATM cards and Zylo motorcycle. Immediately after the occurrence the petitioner was apprehended and from whom Zylo motorcycle was recovered.

It is submitted by learned counsel for the petitioner that the petitioner was not put on TIP and a statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Co-accused Subodh Sah has been granted bail

Patna High Court Cr.Misc. No.12966 of 2015 (04) dt.26-06-2015 2/2 vide Cr. Misc. No. 17091 of 2015.

Considering the fact that the recovery has been made immediately after the occurrence, this Court is not inclined to grant bail to the petitioner for the present in connection with Katoriya P.S. Case No. 331 of 2014 pending in the court of learned Judicial Magistrate, Ist Class, Banka. Accordingly, the prayer for bail of the petitioner is rejected.

However, the petitioner will be at liberty to renew his prayer for bail after completing one year in custody. (Dinesh Kumar Singh, J) DKS/- U T
